The Pilates Room Amsterdam – Terms & Conditions
1. The Agreement
1.1
The Agreement comes into effect upon receipt of a booking confirmation email sent through The Pilates Room Amsterdam's booking system for participation in Pilates sessions, including private sessions, duo sessions, and small group classes.
1.2
Before commencing sessions, the Client may be required to complete and submit a registration form and/or health questionnaire to The Pilates Room Amsterdam.
1.3
By purchasing a package, membership, session, or any other service from The Pilates Room Amsterdam, the Client confirms that they have read, understood, and agreed to these Terms & Conditions.
2. Own Risk and Liability
2.1
The Client participates in Pilates sessions entirely at their own risk.
2.2
The Pilates Room Amsterdam shall not be responsible for, and cannot be held liable for, any damage, loss, or theft of the Client’s property, nor for any form of physical injury incurred before, during, or after Pilates sessions, except where liability cannot be excluded under applicable law.
3. Payment
3.1
The Client shall pay the applicable fees before commencing Pilates sessions. Payment may be made via bank transfer, debit card, credit card, online payment system, or any other payment method accepted by The Pilates Room Amsterdam.
3.2
All packages, memberships, private sessions, duo sessions, small group classes, workshops, and other prepaid services must be paid in full prior to the commencement of the first class, session, workshop, or service to which the purchase relates.
3.3
All purchases, packages, memberships, and individual sessions are non-refundable and non-transferable, except where required by applicable law.
3.4
If the Client fails to make payment on time, they shall be deemed in default without further notice. Interest may be charged at a rate of 4% per month or the applicable statutory interest rate if higher. Interest shall be calculated from the date the payment became due until the date of full payment. An administrative fee of €40 may also be charged.
3.5
If The Pilates Room Amsterdam is required to engage a debt collection agency or initiate legal proceedings due to non-payment, all judicial and extrajudicial costs incurred shall be borne by the Client.
4. Validity of Packages
4.1
All packages for private sessions, duo sessions, and small group classes are valid for the period stated at the time of purchase. The validity period starts on the date of purchase.
4.2
The Client is responsible for using all purchased sessions within the applicable validity period.
4.3
Client absences, regardless of reason, do not extend the validity period of any package.
4.4
Unused sessions remaining after the validity period has expired are non-refundable, non-transferable, and cannot be exchanged for cash, credit, or extensions.
5. Exclusion
5.1
The Pilates Room Amsterdam may refuse participation if the Client has not completed any required registration documentation.
5.2
The Pilates Room Amsterdam may refuse participation if the Client has not fulfilled their payment obligations.
5.3
The Pilates Room Amsterdam may refuse participation if the Client fails to comply with studio rules or behaves in a manner that disrupts sessions or endangers others.
5.4
The Pilates Room Amsterdam reserves the right to refuse participation where the Client’s physical condition may create an unreasonable health or safety risk. The instructor’s professional assessment shall be decisive.
6. Cancellation by the Client
6.1
Pilates sessions are held by appointment and subject to availability.
6.2
If cancellation is made more than 24 hours before the scheduled start time of the session, the session will not be charged and no package credit will be deducted.
6.3
If cancellation is made less than 24 hours before the scheduled start time, the full session fee or applicable package credit will be charged.
7. Cancellation or Changes by The Pilates Room Amsterdam
7.1
The Pilates Room Amsterdam reserves the right to change session dates, times, instructors, or locations when reasonably necessary.
7.2
The Pilates Room Amsterdam may cancel a scheduled Pilates session, modify a package arrangement, or refuse participation where reasonably necessary. In such cases, any unused prepaid sessions affected by the cancellation will be credited to the Client’s account or rescheduled. No cash refunds will be provided, except where required by applicable law.
7.3
If an instructor is unable to conduct a scheduled session, The Pilates Room Amsterdam will make reasonable efforts to arrange a substitute instructor.
7.4
If no substitute instructor is available, affected sessions will not be charged.
7.5
For Small-Group Classes, The Pilates Room Amsterdam reserves the right to cancel a scheduled class if fewer than two participants are booked. The Client will be notified as soon as reasonably possible and, where possible, offered an alternative session or rescheduled session.
8. Personal Data
8.1
Client personal data shall be treated confidentially and processed in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).
8.2
Personal data will be used solely for administrative, operational, health and safety, and training-related purposes.
9. Client Responsibilities
9.1
The Client shall promptly inform The Pilates Room Amsterdam of any changes to their contact details.
9.2
The Client shall promptly inform their instructor of any changes to their physical condition, injuries, medical conditions, pregnancy status, or medication use that may affect participation.
9.3
The Pilates Room Amsterdam shall not be liable for any consequences resulting from the Client’s failure to provide accurate or updated information.
10. Amendments by The Pilates Room Amsterdam
10.1
The Pilates Room Amsterdam reserves the right to amend its studio rules at any time.
10.2
The Pilates Room Amsterdam reserves the right to amend these Terms & Conditions at any time.
10.3
The Pilates Room Amsterdam may adjust its pricing from time to time. New prices shall apply only to purchases made after the effective date of the change.
10.4
The most recent version of the Studio Rules and Terms & Conditions is available upon request and on the website of The Pilates Room Amsterdam.
10.5
In situations not covered by these Terms & Conditions, The Pilates Room Amsterdam shall make a reasonable decision.
10.6
Publication of a revised version of these Terms & Conditions replaces all previous versions.
11. Applicability and Disputes
11.1
These Terms & Conditions apply to all agreements relating to Pilates sessions, including private sessions, duo sessions, small group classes, workshops, courses, and any other services provided by The Pilates Room Amsterdam.
11.2
Any deviation from these Terms & Conditions shall only be binding if confirmed in writing by The Pilates Room Amsterdam.
11.3
All teaching materials, methods, content, and intellectual property used by The Pilates Room Amsterdam remain its property. Reproduction, distribution, recording, or publication of any materials or class content is prohibited without prior written consent.
11.4
All agreements and services provided by The Pilates Room Amsterdam shall be governed exclusively by Dutch law.
11.5
Any disputes arising from these Terms & Conditions shall be submitted to the competent court in Amsterdam, the Netherlands, unless mandatory law provides otherwise.
